RentHistory.org (the "Service", "Website" , "Platform") is owned and operated by RIOT MOTION LLC (the "Company").

Acceptance of Terms

By accessing or using RentHistory.org, you agree to comply with and be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must immediately cease all use of the Platform.

Informational Purposes Only

The Platform provides information for informational purposes only. No content provided on the Platform constitutes legal, financial, or professional advice. You expressly agree to consult with a licensed professional to address your specific needs prior to taking any actions based on the information provided on the Platform.

Liability Disclaimer

The Company, its officers, directors, employees, affiliates, agents, contractors, licensors, and suppliers (collectively, "Affiliated Parties") expressly disclaim all liability for any damages, losses, or harm arising from your use of the Platform, reliance on its content, or any actions taken as a result of such reliance. Use of the Platform is entirely at your own risk.

Prohibited Use

The Platform is strictly prohibited from use by landlords, property managers, leasing agents, or any other individuals or entities involved in the leasing, management, or operation of rental properties, as well as anyone affiliated with such parties. This prohibition is intended to ensure the Platform is used solely for its intended purposes and to protect tenant rights. Unauthorized use may result in legal action.

The Platform may only be used for lawful, respectful, and constructive purposes related to housing advocacy and tenant awareness. The following uses are strictly prohibited:

Fraudulent Registration by Landlords

RentHistory.org is a platform created exclusively for tenants, tenant organizers, and housing advocates. Landlords, property managers, leasing agents, or anyone acting on their behalf are strictly prohibited from creating accounts or using the Platform under any circumstances.

By registering for an account, you affirm that you are not a landlord, property manager, or representative of any party engaged in the ownership, management, or leasing of residential properties.

If you are a landlord or affiliated party and proceed to create an account, you acknowledge that you are doing so maliciously and fraudulently, with the intent to mislead, obstruct, monitor, or surveil tenant activity. You further acknowledge that such behavior constitutes a violation of New York Real Property Law § 230, which protects the right of tenants to form, join, or participate in tenant organizations without harassment, retaliation, or interference from landlords or their agents.

By submitting a fraudulent registration as a landlord or affiliated party, you place yourself in direct violation of this Agreement and affirmatively agree to be held accountable for any harm caused to tenants or advocates as a result of your unauthorized access. The Company reserves the right to immediately suspend or delete any account believed to be created by a landlord or related actor and to pursue all available remedies in law, equity, and public disclosure.

Account Responsibilities

If you create an account on the Platform, you are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify the Company immediately of any unauthorized use of your account. The Company is not liable for any loss or damage arising from your failure to maintain account security.

Services Provided

The Platform offers rent history analysis based on publicly available records and user-submitted data. The Company does not guarantee the accuracy, completeness, or reliability of the data or analysis provided. The Company assumes no responsibility for errors, omissions, or inaccuracies in the content.

Payments & Billing

Third-Party Payment Processor:
RentHistory.org uses Stripe as its third-party payment processor to securely handle all payment transactions. By submitting your payment information, you agree to Stripe’s Terms of Service and Privacy Policy. RentHistory.org does not store or process your payment details directly.

Non-Tax Deductibility:
RentHistory.org is not a nonprofit or 501(c)(3) organization. Payments made on the Platform are not tax-deductible.

Digital Services:
All payments are made in exchange for access to digital services, subscriptions, or premium features as described at the time of purchase. These services are considered delivered upon activation of access, alerts, analysis, or account upgrades.

No Refunds:
All payments are final and non-refundable. This includes, but is not limited to, subscriptions, alerts, landlord report access, and analysis services. If you experience an issue with billing or service access, please contact us at support@renthistory.org.

By submitting a payment, you acknowledge that you have read, understood, and agree to these terms and the service details described on the Platform.

Watchdog Engine™ Subscription Terms

By enrolling in the Watchdog Engine™ tier and submitting your payment information via Stripe, you agree to the following terms specific to this monitoring service:

By signing up for the Watchdog Engine™ and providing payment information, you agree to these additional terms alongside the general Terms of Service and our Privacy Policy.

MyAdvocate™ Disclaimer & Terms

The MyAdvocate™ feature allows users to engage in real-time conversations with individuals who have volunteered or contracted as community advocates. These advocates are not licensed attorneys, nor are they certified, trained, or credentialed professionals. They are primarily tenants or tenant advocates with prior experience navigating housing issues.

All messages, suggestions, commentary, and guidance shared by your assigned advocate reflect their personal opinions or experiences and do not represent the views or official advice of RentHistory.org or RIOT MOTION LLC.

By using the MyAdvocate™ feature, you acknowledge and accept these terms, and release the Company and all affiliated parties from any claims, losses, or consequences arising from information exchanged with your assigned advocate.

Retention and Use of Uploaded Rent History Documents

By uploading or submitting rent history documents to RentHistory.org—whether in the form of plaintext, image files, PDF documents, or any other format—the user acknowledges and agrees that these documents are not subject to deletion requests and will be retained indefinitely.

Furthermore, the user grants the Company and its affiliates an unrestricted, irrevocable, and perpetual right to use, share, distribute, and publicly disclose this data at the Company’s discretion. This includes, but is not limited to:

By providing this data, the user waives any claims to its confidentiality and agrees that the Company and its affiliates may use the information in any manner that aligns with its mission to promote transparency, accountability, and tenant rights.

Beta Tools and Feature Availability

By using RentHistory.org, you acknowledge and agree that certain tools, features, or sections of the Platform may be offered in beta or experimental form. These components may be incomplete, subject to change, or temporarily non-functional as they undergo active development, testing, or maintenance.

The Company makes no guarantees regarding the availability, accuracy, performance, or uninterrupted operation of beta tools or features. Access to these tools is provided “as is” without warranty of any kind, and their presence on the Platform does not imply a finalized or production-grade offering.

You agree that the Company shall not be held liable for any disruption, removal, inaccuracy, or unexpected behavior associated with tools still under development. Your use of such features is entirely voluntary and at your own risk.

Termination

The Company reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for any violation of these Terms or any applicable laws. Termination does not waive or affect any rights or remedies available to the Company under these Terms or applicable law.

Limitation of Liability

To the fullest extent permitted by law, the Company and its Affiliated Parties shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform or inability to use the Platform, even if the Company has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its Affiliated Parties from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from or related to your use of the Platform or violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to the jurisdiction of such courts and waive any objections to venue or jurisdiction therein.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, the remaining provisions shall remain valid and enforceable to the maximum extent permitted by law.

If you need to regain access to your account, would like to delete your data from our server, or need any assistance regarding the contents of your account, you must contact us from the email address you provided during your registration. If you no longer have access to the provided email address, you can verify your identity over the phone from the telephone number you provided us during your registration. If you do not have access to either, or if you lost access to your email address & chose not to provide us with a telephone number during your registration, then for security reasons we cannot help you.
